These Terms of Use ("Terms") govern your access to and use of the Robin Warner Neurology, PLLC website (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) Acceptance of Terms; Changes
We may update these Terms from time to time. The "Last Updated" date above indicates when these Terms were most recently revised. Your continued use of the Site after changes are posted means you accept the revised Terms.
2) Medical Disclaimers; No Emergency Use; No Physician-Patient Relationship
No medical advice. The Site is for general informational purposes only and is not medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition.
No reliance. Do not rely on information on the Site as a substitute for professional medical advice, diagnosis, or treatment. Use of the Site is at your own risk.
No emergencies. The Site is not for medical emergencies and is not monitored 24/7. If you believe you may have an emergency, call 911 or go to the nearest emergency department.
No physician-patient relationship. Using the Site, submitting a contact request, sending us a message through the Site, or using any appointment request or scheduling functionality does not create a physician-patient relationship. A physician-patient relationship is established only if (and when) the Practice expressly agrees to accept you as a patient, you complete any intake and consent processes we require, and you are seen by a provider from the Practice.
Appointment requests are not guaranteed. Submitting an appointment request or interacting with scheduling tools does not guarantee an appointment time, confirmation, or that the Practice will be able to provide services. We may need additional information to confirm scheduling.
Do not send sensitive information through the Site. Do not submit sensitive or clinical information through general website forms or standard email. When available, use the patient portal for clinical communications.
3) Website Use and Access
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use in accordance with these Terms.
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to any portion of the Site or related systems or networks
- Interfere with or disrupt the Site or servers/networks connected to the Site
- Use any robot, spider, scraper, or other automated means to access the Site without our express written permission
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site except as expressly permitted by us in writing
- Modify, adapt, translate, or reverse engineer any portion of the Site
- Remove any copyright, trademark, or other proprietary notices
- Introduce viruses, malware, or other harmful code
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
Changes to the Site. We may modify, suspend, or discontinue the Site (or any part of it) at any time without notice, including by adding, removing, or changing content, features, or availability.
4) User Content and Communications
Your submissions. If you submit information to us through the Site (for example, via a contact form or email link), you represent that the information is accurate to the best of your knowledge and that you have the right to provide it.
Limited permission to use your communication. By submitting communications through the Site, you grant the Practice a limited permission to use, store, reproduce, and share the communication only as reasonably necessary to:
- respond to you and provide the information or services you request,
- operate, maintain, secure, and improve the Site and our operations,
- document and manage administrative interactions, and
- comply with applicable law, regulation, or professional obligations.
We may share communications with our service providers solely to perform services for us (for example, website hosting, IT support, spam prevention), subject to appropriate confidentiality and security obligations.
Not secure; not monitored continuously. Communications sent through the Site or standard email may not be secure and may not be reviewed immediately. Do not use these methods for urgent requests or sensitive medical details.
We may retain communications. We may keep records of communications for administrative, operational, and legal purposes.
5) Intellectual Property
The Site and its content, features, and functionality (including text, graphics, logos, design, and compilation) are owned by the Practice or its licensors and are protected by intellectual property laws. You may not use the Practice's name, logo, or trademarks without our prior written consent.
6) Third-Party Services and Links
The Site may include third-party services, embedded tools, or links to third-party websites. These third parties may collect information from you under their own terms and privacy practices. We do not control, and are not responsible for, third-party content, policies, or practices.
Scheduling/booking tools. If the Site includes an appointment request or booking feature provided by a third party (for example, an embedded scheduling widget), any information you submit through that tool is processed by that third party and may also be received by the Practice as part of our administrative and clinical workflows.
Patient portal. If the Site links to a patient portal, your use of the portal is governed by the portal provider's terms and policies.
Directories and reviews (optional; may be added). From time to time, the Site may link to or integrate third-party directories or review platforms (for example, Zocdoc). If we add links or embedded content from these services, they may collect information when you view or interact with that content, governed by their policies.
7) Disclaimers
The Site is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
8) Limitation of Liability
To the fullest extent permitted by law, the Practice and its members, managers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, the Practice's total liability for all claims relating to the Site will not exceed $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
9) Indemnification
You agree to indemnify, defend, and hold harmless the Practice and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.
10) Privacy; Notice of Privacy Practices
Our collection and use of information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.
If you are a patient, our use and disclosure of protected health information is governed by HIPAA and our Notice of Privacy Practices (NPP).
11) Practice Discretion; Non-Discrimination; Relationship Changes
Before a physician-patient relationship is established. To the extent permitted by applicable law, we may decline requests for appointments or services based on factors such as scope of practice, capacity, clinical appropriateness, administrative considerations, payment/coverage considerations, conflicts, or other legitimate factors.
Non-discrimination. We do not discriminate on the basis of legally protected characteristics.
After a physician-patient relationship is established. If a physician-patient relationship has been established, any termination of that relationship will be handled in a manner intended to be consistent with applicable law and professional obligations, including appropriate notice and continuity/transition considerations where required.
12) Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
13) Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
14) Entire Agreement
These Terms (together with the Privacy Policy and any other policies or notices posted on the Site) constitute the entire agreement between you and the Practice regarding your use of the Site.
15) Waiver
No waiver of any term will be deemed a further or continuing waiver of that term or any other term. Any failure to assert a right or provision under these Terms will not constitute a waiver of such right or provision.
